We only represent Parents and Children.  We never represent School Districts or Special Education Local Area Plans (SELPA’s).

The Special Education Law Firm offers two alternative ways in which to engage our services, our Annual Fee Program and our Standard Time and Expense Program.

1.  Annual Fee Program for Clients With No Additional Fees To Qualifying Parents

Our fee schedule is based on both your income and your location. Listed below are some tables explaining our fees. All prices are subject to change without notice. You and we must sign an engagement contract before we can begin representing you. You may buy our services for an annual charge (“retainer fee”) and we will receive other fees on a contingency basis (the School District may or may not pay). Read the engagement contract between you and us for full details.

We provide services in the following school districts for the fees listed in the table below:

1. The Long Beach Unified School District for students living in Long Beach, Lakewood, and Signal Hill.

2. The Los Alamitos Unified School District for students living in Los Alamitos, Rossmoor, Seal Beach, Surfside, and small portions of Cypress and Long Beach.

3. The Bellflower Unified School District for students living in Bellflower.

4. The ABC Unified School District for students living in the cities of Artesia, Cerritos, Hawaiian Gardens, as well as portions of Lakewood, Long Beach, and Norwalk.

5. The Cypress School District for students living in Cypress.

6. Paramount Unified School District for students living in Paramount.

Please see the second Fees table below if your child is not in one of the above school districts.

 

The Special Education Law Firm has a payment plan available for those parents who cannot immediately pay the full amount.

We provide services in the following school districts for the fees listed in the table below:

1. Orange County school districts not listed above.

2. Los Angeles County school districts not listed above.

There are no additional fees unless you, the parent, want to pay for special testing that we cannot provide for free.

The Individuals with Disabilities Education Act (IDEA) requires the school district to pay the attorney fees to parents if the parents prevail in a dispute. However, until the hearing process begins, the school district has no obligation to pay attorneys fees, and then only if the parents “prevail.” If the parents prevail against the school district, only those attorney fees they incur after the due process complaint has been filed are subject to reimbursement by the district. The United States Supreme Court has recently ruled that the district is not obligated to reimburse the cost of expert witnesses.

We encourage you to call our office to discuss your child’s special education needs. There will be no charge for that call. We will discuss the possible outcomes and the fees for which you may become responsible. If you decide to proceed, we will send you an engagement contract for your review. If you wish to have us represent you, then an engagement contract that describes our attorney-client relationship will be signed by both parties as required by the California State Bar.

 

2. Standard Time and Expense Program

If you elect our standard time and expense program to govern our attorney-client relationship, we normally require a deposit against fees to be charged and costs to be advanced at the time the engagement contract is signed. The deposit will be placed in our client trust account, less a nonrefundable retainer fee. At the end of each month, we will send you a statement. We will deduct the amount due on that statement from the client trust account and expect you to make a payment in the same amount to replenish the amount on deposit.

Lawyer and advocate times are tracked in 0.20 hour increments. Lawyer time is billed at $395 per hour, while senior paralegal advocate time is $175 per hour and paralegal advocate time is $150 per hour. Ordinarily, there are minimum charges of 0.20 hours for any office time and 2.00 hours for a conference, hearing or court appearance. Telephone calls are billed at regular rates. Travel time and time waiting for hearings or conferences are billed at ordinary rates for either lawyer or advocates. In addition, you will be responsible for all costs, such as filing fees, when they are incurred. Rates are subject to change with 60 days advance notice.
